Terms of service - Pickey.ai
Data : Refers to any kind of information that a user can generate, use, share or remove on the PicKey.ai platform or otherwise. This may include user personal data, credentials, pictures, virtual objects, pointclouds etc.
PicKey.ai ,Neural Heaven Inc : “The Company”, “we”, “us” refers to the password management product and all of the services offered including and not limited to mobile apps, web apps, virtual environments, passwords, etc.
Pictorial/Photographic Memory : refers to the mechanism by which the concept of visual remembrance is established - in both living organisms and in computer systems. The implementation, accuracy, time taken, storage and other parameters may be different for each of these systems and the concept may be used to explain how artificial intelligence systems work.
Service : The PicKey.ai apps, website and browser extensions.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, USA without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.
We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.
No waiver by Company of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert a right or provision under Terms shall not constitute a waiver of such right or provision. If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.
Pickey.ai offers rewards and badges when users complete certain stages to strengthen their password safety, app exploration and security. These rewards are provided as a part of the App experience. The company may add, change, or remove rewards at its discretion, and their provision does not create any obligation or guarantee on behalf of the Company.
While the Pro and Family Plans allow users to store an unlimited number of passwords, the Company reserves the right to apply a reasonable and system-determined fair usage limit in order to prevent misuse, abuse, or activities inconsistent with normal personal or family use. The fair usage limit is designed to ensure service quality and security for all users and may be adjusted from time to time at the Company’s sole discretion. Accounts that exceed such limits or exhibit patterns of misuse may be subject to review, temporary restriction, or suspension.
The current fair usage limit for the number of stored passwords is set at 1,000. The Company reserves the right to modify this limit at its sole discretion.
Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using any of our Services, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.
The company does not knowingly collect personal data from minors. If a parent or guardian believes their child’s data was provided,you can contact support to delete such information - info@pickey.ai
Age Criteria
The service is intended for individuals who are at least 18 and above in terms of age.
We only use cookies to store your acceptance to the EULA and terms and conditions document. Site statistics engines like Meta Pixel and Payment Gateways are also available and may use cookies for their functionality to work. PicKey.ai neither stores your personal data in cookies, nor any other kind of data except the one mentioned above.
The Company may host content that could include sensitive themes such as explicit language, mature references, depictions of violence, substance use, or other material intended for a mature audience. If you do not agree with this, then you are prohibited from both the access and usage of Service. Additionally, you should be at least eighteen (18) years old to use any of our services.
None of the authors, contributors, administrators, vandals, or anyone else connected with Neural Heaven Inc, in any way whatsoever, can be responsible for your use of the information contained in or linked on all PicKey.ai platforms, websites, browser extensions, mobile apps etc.
NeuralHeaven Inc is not responsible for any errors or omissions, or for the results obtained from the use of this information. All information in this site is provided "as is", with no guarantee of completeness, accuracy, timeliness or of the results obtained from the use of this information.

COMPANY DOES NOT WARRANT OR GUARANTEE THAT YOU WILL NOT LOSE DATA, LOSE ACCESS TO YOUR ACCOUNT, OR EXPERIENCE UNAUTHORIZED ACCESS RESULTING FROM YOUR OWN ACTIONS OR OMISSIONS, INCLUDING BUT NOT LIMITED TO THE CREATION OF WEAK OR EASILY GUESSABLE MASTER KEYS, FAILURE TO SECURE YOUR LOGIN CREDENTIALS, OR OTHER USER MISMANAGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EXCEPT AS PROHIBITED BY LAW, THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM or $100 whichever is lesser
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to info@pickey.ai, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims” You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.
Collectibles used as part of the PicKey application are sourced from Sketchfab under CC0 or CC BY licenses, with appropriate credit provided to the original artists in accordance with the license terms.
You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail): an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest; a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work; identification of the URL or other specific location on Service where the material that you claim is infringing is located; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
You are responsible for maintaining the confidentiality of your account and related keys/passwords, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, cancel subscriptions and purchases at our sole discretion.
You agree that any image or content you choose will not contain material that is offensive, harmful, illegal, discriminatory, abusive, pornographic, or otherwise inappropriate. The Company reserves the right, at its sole discretion, to review, restrict, or remove any image or content that violates these standards or that we reasonably believe may compromise the safety, security, or experience of our users.
PicKey.ai reserves the right to suspend or terminate services of any user. This may include incidents of service misuse, indecent behavior, risks to law enforcement etc.
You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

Neural Heaven, Inc may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”). You may be required to enter your billing information in order to sign up for Free Trial. If you do enter your billing information when signing up for Free Trial, you will not be charged by Neural Heaven, Inc until Free Trial has expired. On the last day of Free Trial period, unless you canceled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected. At any time and without notice, Neural Heaven, Inc reserves the right to (i) modify Terms of Service of Free Trial offer, or (ii) cancel such Free Trial offer.
Neural Heaven, Inc, in its sole discretion and at any time, may modify Subscription or Offered Merchandise and their fees/price. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Neural Heaven, Inc will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Neural Heaven, Inc, also reserves the right to add/update/remove any of the services, subscriptions and Merchandise offered though our platforms and channels.
Purchase : Your purchases can be viewed by going to the “Settings > Purchases” section. You will be able to see options of Subscription, Collectable purchases in this section.
Refunds : If you are not satisfied with your purchase, you can ask for a refund within 30 days of the purchase. Please note that this will also revoke all benefits/services you had obtained as part of the purchase.
The Company does not currently provide or commit to any specific service level agreements (“SLAs”) with respect to the availability, performance, or response times of the product
Notwithstanding the foregoing, the Company will use reasonable efforts to monitor, identify, and address technical issues, disruptions, or service-related concerns in a timely and proactive manner to minimize any impact on users.
Use of TrueDepth APIs on Apple Devices
The iOS App uses the TrueDepth API only to place 3D objects (virtual masks) on a user’s face. Other than this function, the App does not make any other use of the TrueDepth API. The App neither collects, nor stores data of any kind using the TrueDepth API. Also, no other third-party is involved in collection, storage or access of data of any kind with the TrueDepth API.
Any participation in PicKey.ai’s services will constitute acceptance of this agreement. By using any of our services, you acknowledge that you have read these terms of service and agree to be bound by them.
Policy updates
We may update our privacy policy from time to time. If we make significant changes, we will notify you through the app or via email. The date of the latest revision will be indicated at the top of the policy. We encourage you to review the policy periodically.
